Welcome to Andrew Molleur Studio. These Terms of Service ("Terms") govern your use of www.andrewmolleur.com (the "Site") and the purchase of products and services from Andrew Molleur Studio ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Site or purchase our products.

1. General Use of Site

By using this Site, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. You agree to use the Site only for lawful purposes and in accordance with these Terms.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

2. Products and Availability

All products offered on the Site are handmade, limited-edition, and produced in small quantities. Product descriptions, images, colors, dimensions, and availability are subject to change without notice.

We make every effort to display colors and details as accurately as possible, but we cannot guarantee that your device's display will accurately reflect the actual product colors or textures.

Due to the handmade nature of our work, slight variations in size, color, pattern, and finish are normal and should be expected. These variations are part of the unique character of each piece and are not considered defects.

We reserve the right to limit quantities, discontinue products, or decline orders at any time.

3. Pricing

All prices are listed in USD and are subject to change without notice. We reserve the right to correct pricing errors on the Site or on pending orders. If a pricing error is discovered after an order has been placed, we will notify you and give you the option to proceed at the correct price or cancel your order for a full refund.

4. Orders and Payment

By placing an order through the Site, you are making an offer to purchase products subject to these Terms. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

Payment is processed securely through our payment processor (Stripe, PayPal, or other third-party payment services). You agree to provide current, complete, and accurate payment information. You are responsible for all charges incurred under your account.

5. Production and Shipping

Standard Production Time: Unless otherwise noted on the product page, standard production time is 4-6 weeks from the date of order. This timeline may vary based on order volume, product complexity, and other factors. We will notify you if there are significant delays.

Shipping: Once your order is complete, we will ship it using the carrier and method selected at checkout. Shipping times vary by location and carrier. We are not responsible for delays caused by shipping carriers, customs (for international orders if applicable), weather, or other events beyond our control.

Domestic Shipping Only: At this time, we only ship within the United States. We do not offer international shipping.

Risk of Loss: Risk of loss and title for products pass to you upon delivery to the shipping carrier. We are not responsible for lost, stolen, or damaged packages once they have been delivered to the carrier.

Tracking Information: You will receive tracking information via email once your order has shipped.

6. Returns, Exchanges, and Refunds

Due to the handmade and limited-edition nature of our work, each piece is unique. We do not accept returns or exchanges unless the item arrives damaged or defective.

Damaged or Defective Items:

  • You must inspect your order upon receipt and contact us within 7 days of delivery if you receive a damaged or defective item.

  • You must provide photographic evidence of the damage or defect.

  • We will work with you to resolve the issue, which may include a replacement, repair, or refund at our discretion.

  • Damage claims must be reported within 7 days; we cannot accept claims after this period.

Non-Returnable Items:

  • Custom or commissioned work cannot be returned or exchanged under any circumstances.

  • Products damaged due to misuse, dropping, improper care, or normal wear and tear are not eligible for return or refund.

7. Commissioned and Custom Work

We offer commissioned and custom design work on a case-by-case basis. The following terms apply to all custom projects:

Deposits:

  • A 50% non-refundable deposit is required to begin work on any custom or commissioned piece.

  • The deposit secures your place in our production schedule and covers initial design and materials.

Final Payment:

  • Final payment is due upon completion of the work and before shipping.

  • We will provide photos of the completed work for your approval before final payment and shipping.

Timeline:

  • Estimated completion times for custom work are approximate and subject to change based on project complexity and our production schedule.

  • We will keep you informed of progress and any delays.

No Returns:

  • Custom and commissioned work is made specifically for you and cannot be returned, exchanged, or refundedunder any circumstances, except in cases of significant defects in craftsmanship.

Design Approval:

  • You will have the opportunity to review and approve design concepts before production begins.

  • Changes requested after production has begun may result in additional fees and extended timelines.

8. Intellectual Property

All content on this Site, including but not limited to text, images, graphics, logos, designs, photographs, and product descriptions, is the property of Andrew Molleur Studio and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, perform, publish, license, create derivative works from, or use any content from this Site without our express written permission.

Product Designs: All product designs are original works created by Andrew Molleur and are protected by copyright. You may not copy, reproduce, or create derivative works based on our designs.

9. Product Use and Care

Our products are designed to be functional and food safe (where indicated). However, they should be handled with care as they are handmade objects.

Care Instructions:

  • Follow any care instructions provided with your product or on the product page.

  • Hand washing is recommended for most items unless otherwise specified.

  • Avoid extreme temperature changes, which can cause thermal shock and cracking.

Limitation of Use: We are not responsible for damage resulting from misuse, dropping, improper care, or failure to follow provided care instructions.

10. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or inappropriate activity.

11. User-Generated Content

The Site may allow you to submit reviews, comments, or other content ("User Content"). By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute your User Content in connection with the Site and our business.

You represent that any User Content you submit is accurate, does not violate any third-party rights, and does not contain unlawful, offensive, or inappropriate material.

We reserve the right to remove or refuse to post any User Content at our discretion.

12. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. You access third-party sites at your own risk.

Our Site is powered by Squarespace, and payment processing is handled by third-party payment processors. Your use of these services is subject to their respective terms and privacy policies.

13. Limitation of Liability

To the fullest extent permitted by law, Andrew Molleur Studio shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Site or products, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or related to these Terms or your use of the Site shall not exceed the amount you paid for the product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Andrew Molleur Studio, its owners, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.

15. Disclaimer of Warranties

The Site and all products and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content on the Site.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or failures of third-party services or suppliers.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Any disputes arising out of or related to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Ulster County, New York. You consent to the personal jurisdiction of such courts.

Arbitration: For disputes under $10,000, you agree to resolve the dispute through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, unless you opt out by notifying us in writing within 30 days of first accepting these Terms.

18. Modifications to Terms

We reserve the right to modify or update these Terms at any time. Changes will be effective immediately upon posting to the Site, and the "Effective Date" at the top of this page will be updated.

Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and Andrew Molleur Studio regarding your use of the Site and supersede any prior agreements or understandings.
